By accessing or using The Profit Journal ("Service", "we", "us", "our"), you confirm that you are at least 18 years of age, have read and understood these Terms of Service, and agree to be legally bound by them.
If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these terms.
These Terms apply to all visitors, users, and others who access or use the Service. If you do not agree to these Terms, please do not use our Service.
Your Account
To use The Profit Journal, you must sign in with a valid Google account. By doing so, you agree to:
- Provide accurate and complete information during registration
- Maintain the security of your Google account credentials
- Promptly notify us of any unauthorized use of your account
- Accept responsibility for all activities that occur under your account
- Not share your account with any other person
We reserve the right to suspend or terminate accounts that violate these terms, engage in fraudulent activity, or are inactive for an extended period.
Acceptable Use
The Profit Journal is designed to help traders track and improve their trading performance. You may use the Service to:
- Log and track your personal trading activity
- Analyze your trading performance and statistics
- Use the risk calculator for position sizing
- Participate in the leaderboard with your own trading data
- Export your own trade data for personal use
- Access the Service from multiple personal devices
The Service is for personal use. You are welcome to use it as a professional trader, but commercial resale or redistribution of the platform is not permitted.
Prohibited Use
You agree NOT to use the Service in any way that:
- Violates any applicable local, national, or international law or regulation
- Involves submitting false, misleading, or fabricated trade data
- Attempts to gain unauthorized access to any part of the Service or its infrastructure
- Involves scraping, crawling, or automated data extraction without written permission
- Attempts to reverse engineer, decompile, or disassemble any part of the Service
- Involves uploading malicious code, viruses, or any harmful software
- Harasses, abuses, or harms other users via the leaderboard or any community features
- Impersonates any person or entity, or misrepresents your affiliation
Violation of these prohibitions may result in immediate account termination and, where applicable, legal action.
Intellectual Property
The Service and its original content, features, and functionality are and will remain the exclusive property of The Profit Journal and its creators. This includes:
- The website design, layout, and user interface
- All logos, branding, and visual assets
- The underlying code, algorithms, and software
- All written content, documentation, and guides
You retain full ownership of all trade data and content you submit to the Service. By submitting data, you grant us a limited license to store, process, and display it solely for the purpose of providing the Service to you.
Your trade data belongs to you. We will never claim ownership of your trading records or use them for any purpose beyond operating your journal.
Your Data & Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
- You can export all your trade data at any time from the dashboard
- You can request complete account deletion at any time
- We retain your data for as long as your account is active
- Upon account deletion, all personal data is permanently removed within 30 days
- Anonymized, aggregated data may be retained for product improvement
We implement industry-standard security measures to protect your data. However, you acknowledge that no method of transmission over the internet is 100% secure.
Disclaimers & No Financial Advice
IMPORTANT: The Profit Journal is a journaling and analytics tool ONLY. Nothing on this platform constitutes financial advice, investment advice, or trading recommendations.
Specifically, we disclaim:
- Any guarantee of trading profits or performance improvement
- Responsibility for any trading losses incurred while using the Service
- The accuracy of any analytics, statistics, or calculations for actual trading decisions
- Any warranty that the Service will be uninterrupted, error-free, or secure
Trading financial instruments involves substantial risk of loss. Past performance, even as tracked in your journal, is not indicative of future results. Always consult a qualified financial advisor before making trading decisions.
The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied.
Limitation of Liability
To the maximum extent permitted by applicable law, The Profit Journal and its creators shall not be liable for:
- Any indirect, incidental, special, consequential, or punitive damages
- Any loss of profits, revenue, data, or business opportunities
- Any trading losses or financial damages arising from use of the Service
- Any unauthorized access to or alteration of your data
- Any interruption or cessation of the Service
In no event shall our total liability to you for all claims exceed the amount you paid us in the twelve (12) months preceding the claim, or $100 USD, whichever is greater.
Termination
Either party may terminate the relationship at any time:
- By You: Delete your account at any time from the dashboard settings. All your data will be permanently removed within 30 days.
- By Us: We may suspend or terminate your account immediately, without prior notice, if you violate these Terms or engage in harmful behavior.
Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.
Changes to Terms
We reserve the right to modify these Terms at any time. When we make material changes, we will:
- Update the "Last updated" date at the top of this page
- Send an email notification to all registered users
- Display a prominent notice within the app for 30 days
Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using the Service.
